Fees & Terms of Business
In accordance with the Estate Agents Regulations 1991 Jeremy
Leaf & Co. sets out its terms of business below. As required
by the Estate Agents Act 1979 these terms will be confirmed in writing
upon instruction and the client will be asked to sign and return
a copy of the letter.
Agency & Fees
Jeremy Leaf & Co will act as selling agents for vendors of
property (clients). We will also act on the behalf of purchasers
if required.
We will act as Sole Agents, Joint Sole Agents or Multiple Agents. The fee for each of these agencies will be an agreed percentage of the contract price including any part of that price apportioned to fixtures and fittings. The fee will be payable upon completion of the sale from the completion monies. VAT at the prevailing rate will be added to our fee.
Our Sole Agency or Joint Sole Agency agreement will last until such time as the client or ourselves ends the agreement in writing. No fee is payable if there is no sale.
Sole Agency
On this basis Jeremy Leaf & Co. acts as the only agent instructed
to sell the property.
Our fees would be at a reduced fixed percentage (available on request) of the sale price including fixtures and fittings and become liable for payment if at any time unconditional contracts are exchanged: with a purchaser introduced by us, directly or indirectly, that is any purchaser to whom we introduce the property, or with any purchaser with whom we had negotiations during that period, or with any purchaser introduced by another agent during that period. If the client at a later date instructs another agent or agents as well as ourselves, our fees will be increased to the standard rate (available on request) from the date of the revised instruction.
Joint Sole Agency
On this basis Jeremy Leaf & Co. will act as Joint Sole Agents
with one other agent. For this our fees are a fixed percentage (available
on request) of the contract price including fixtures and fittings.
This fee will be shared on a pre-agreed basis with our joint agent
upon completion of a sale. The fee arrangement relating to payment
is the same as the Sole Agency basis.
Multiple Agency
Multiple Agency is when several agents act independently. On completion, our fees as the successful selling agent would be a fixed percentage (available on request) of the contract price including fixtures and fittings.
Sub-Agency
On this basis Jeremy Leaf & Co. will appoint other selected
agents to act as sub agent. This involves the client in no extra
cost and all viewing and negotiations would be conducted solely
through ourselves unless otherwise agreed with the client in writing.
Legal Right To Sell
Unless otherwise informed in writing Jeremy Leaf & Co. assumes
that the person/persons/company to whom our confirmation of instruction
letter is addressed, has authority to place the property for sale
and is responsible, the name, address and telephone number of the
third party must be disclosed and their written confirmation given
of their agreement for sale and responsibility to Jeremy Leaf &
Co. for payment of the fee.
Asking Price
The agreed asking price is not a formal valuation, but a guideline of the expected sale price in prevailing market conditions.
Jeremy Leaf & Co. has not carried out a survey, nor a local
search, nor read the Deeds or the Lease and the purchase price will
assume there are no legal or structural matters adversely affecting
the property unless otherwise stated in writing.
